  • Third-Party Healthcare Providers refers to independent hospitals, clinics, specialized medical facilities, doctors, and medical professionals operating in China.
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

1. Crucial Medical Disclaimer (NO MEDICAL ADVICE)

THIS IS THE MOST IMPORTANT SECTION OF OUR TERMS. PLEASE READ CAREFULLY.

China Medical Portal is strictly a medical concierge, logistics, and administrative coordination service. We are NOT a healthcare provider, medical facility, or clinical consultancy.

  • No Medical Advice: The content provided on the Website and through our Service is for informational and administrative purposes only. It does not constitute medical advice, diagnosis, treatment, or clinical recommendations.
  • Independent Decisions: You must always seek the advice of your physician or other qualified healthcare providers with any questions you may have regarding a medical condition or treatment plan.
  • In Case of Emergency: If you think you may have a medical emergency, call your local emergency services or go to the nearest hospital immediately. We do not provide emergency medical interventions.

3. Third-Party Healthcare Providers & Services

Our Service involves coordinating your access to Third-Party Healthcare Providers in China.

  • Independent Contractors: All hospitals, clinics, and medical professionals are independent third parties. They are not employees, agents, or representatives of China Medical Portal.
  • No Guarantee of Outcome: While we assist in navigating the hospital systems and coordinating appointments, We have no control over, and assume no responsibility for, the quality of medical care, clinical outcomes, or acts and omissions of any Third-Party Healthcare Providers.
  • Direct Relationship: Your medical treatment establishes a direct patient-provider relationship between You and the Third-Party Healthcare Provider. Any disputes regarding medical treatment must be resolved directly with the respective healthcare provider.

4. On-Ground Logistics and User Responsibilities

When utilizing our on-ground concierge services (including but not limited to airport transfers, accommodation arrangements, and hospital navigation):

  • Accurate Information: You agree to provide accurate and complete non-clinical administrative information required for us to facilitate your logistics and hospital registrations.
  • Travel Documentation: You are solely responsible for ensuring you have valid passports, visas, and necessary travel documentation to enter and remain in China.
  • Behavioral Conduct: We reserve the right to terminate on-ground support services if a user engages in abusive, illegal, or severely disruptive behavior towards our local coordinators or medical staff.

5. Privacy and Confidentiality

Your privacy is paramount. While we manage non-clinical administrative paperwork and logistics, we adhere to strict confidentiality protocols. Our use of any personal or administrative data you provide is governed by our Privacy Policy. We do not access your detailed clinical medical records unless explicitly required and authorized by You strictly for translation or hospital registration purposes.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company, its directors, employees, or local coordinators be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for medical complications, loss of profits, or travel disruptions) arising out of or in any way related to:

  1. The medical services or clinical advice provided by Third-Party Healthcare Providers.
  2. Your use of or inability to use our logistics and coordination Service.
  3. Any actions or omissions of third-party transport or accommodation vendors in China.

Our total liability to You for any administrative or logistical failure of the Service shall be strictly limited to the amount actually paid by You directly to the Company for the specific concierge service in question.

7. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. The Company provides no warranty that the Service will perfectly meet Your requirements or operate without unforeseen local disruptions (such as traffic, weather, or sudden changes in hospital administrative policies).

8. Governing Law

The laws of China, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Website and our on-ground services may also be subject to local laws in the People’s Republic of China.

9. Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company directly. We are committed to ensuring your experience is as seamless as possible and will work diligently to address administrative or logistical concerns.

10. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
